Pharmacy Case Settles for Millions
Aaron Freiwald reached a settlement in a pharmacy negligence case for terms valued at more than $4 million. The specific terms of the settlement are confidential, as are the particulars of the case.
"We are seeing a growing number of pharmacy negligence cases, both against retail pharmacies and in cases where there are medication errors in the hospital setting," said Mr. Freiwald. "I am gratified that we were able to achieve such a meaningful settlement for the child who received the wrong medication in the case we handled and that he will be provided for in the years to come."
In June 2005, Mr. Freiwald and Mr. Layser were course planners in a continuing legal education seminar entitled, "Rx: Medication Error Liability." The seminar, which was presented in Pittsburgh and Philadelphia, set forth useful background on the law of medication error liability and discussed some of the considerations in preparing and litigating these kinds of cases. David Kane, who is of counsel to the firm and is also a licensed pharmacist, also made a presentation at the seminar.
